Since January 2022, the City of Tucson has issued 1,871 solar permits. In a typical year, roughly one in five of those permits also carried a panel or service upgrade filed inside the same paperwork — not as a separate permit of its own — which means a search that only looks for standalone "panel upgrade" permits can miss work that's actually on file. The reverse matters just as much: an address with no standalone upgrade permit hasn't necessarily gone without one. The upgrade may simply be described inside the solar permit itself.

Why the paperwork matters when solar changes hands
A house changes hands with its systems, permitted or not. Buyers and lenders sometimes ask about permit history, some insurers ask directly about panel type and prior electrical work when writing or renewing a policy, and a utility doesn't treat a system as properly interconnected just because panels are on the roof. None of these outcomes is automatic — every insurer, lender, and buyer behaves differently — but the pattern shows up often enough at resale that it's worth checking before closing rather than after.
Arizona sellers complete a Seller's Property Disclosure Statement and are expected to disclose known material facts, which can include unpermitted work; sellers who don't can face buyer claims after closing (Nolo, HomeLight). Whether a solar system's permit status counts as something a given seller "knows" is a case-by-case question. The safer position, for a seller or a buyer, is to look at the record before it becomes a dispute.
A solar permit can hide the panel upgrade
Many solar arrays draw more amperage than an existing panel or service was sized for, so installers sometimes fold the upgrade into the same permit rather than pulling it separately. Since 2022, the share of Tucson residential solar permits that also carried a panel or service upgrade inside the same filing has run:
- 2022 — 17.8%
- 2023 — 14.8%
- 2024 — 23.1%
- 2025 — 18.8%
Put another way, in most years roughly one in five solar permits is also, quietly, a service-upgrade permit. Search only for a standalone "panel upgrade" filing at an address and you can walk right past it.
A missing standalone panel-upgrade permit is not proof the panel was never touched. It may mean the upgrade is described inside the solar permit's own paperwork, or that no upgrade was needed, or that the work happened without a permit at all. A permit on file is strong evidence of what it says; the absence of one is weak evidence of very little.
The 120% rule, in plain words
Grid-tied solar is generally sized against a limit in the National Electrical Code, NEC 705.12, that installers call the "120% rule": in the most common configuration, the solar breaker and the main breaker feeding a panel's busbar can't, between them, add up to more than 120% of what that busbar is rated to carry. There are other ways to comply — supply-side taps, specific breaker placement, a larger busbar — so the rule doesn't describe every install identically, and this is general background, not an assessment of any specific panel.
What it tends to mean later: a panel already at its backfeed limit for solar may have little or no room left for something else that also feeds current — a second inverter, a battery, an added circuit — without a panel or busbar change. That's a fair question to ask before adding an EV charger, a battery, or more solar to a house that already has a system, typically rather than always, and specific to the panel in question. Where an upgrade also changes the electrical service itself — a new meter base, larger service conductors — TEP requires its own New Service application and an equipment-access appointment, separate from the City permit, which is one more reason the permit paperwork and the utility paperwork don't always tell the same story.
Leased vs. owned, and what a title search can turn up
Whether a system is owned outright or financed through a lease or power-purchase agreement doesn't change whether it was permitted, but it does change what a title company's search can turn up. Leased and PPA systems are commonly recorded against the property with a UCC filing, and an unresolved filing at closing can slow or complicate a transfer, in general terms and not as legal advice; a real estate attorney or title company handles the specifics of any given transaction.
For a buyer, that means asking early whether a system is owned or leased and, if leased, getting the payoff or transfer terms and the UCC filing's status well before the standard Arizona contract's inspection period, typically 10 days, runs out. For a seller, it means having that paperwork ready before a buyer's title company finds it first.

Solar permits show up with their filed description, and where that description also names a panel or service upgrade, the lookup flags it, rather than treating solar and panel work as two separate questions.

How to check before you buy, sell, or add load
A few minutes with the public record answers most of what's checkable before anyone climbs a ladder:
- Look up the address below and read the solar permit's filed description for upgrade language, not just its permit type.
- If a City of Tucson permit has plan documents attached, use the AI plan-set read for array size, inverter, and interconnection details.
- Ask the seller — or, if you're the seller, gather now — whether the system is owned or under a lease or PPA, and if leased, the UCC filing and payoff terms.
- Confirm the permit's status is an actual completion status for its source (City "Final" or "Inspections Complete," county and Oro Valley have their own equivalents), not "Approved" or "Fees Paid," which aren't the same thing.
- For anything the record can't settle — the physical panel, whether backfeed capacity is already spoken for, whether interconnection is actually complete — have a licensed electrician verify it in person before closing or before adding load. The Arizona Registrar of Contractors' license lookup confirms a contractor's license is active before you hire them.
