What “unpermitted” means, and why the jurisdiction matters
Arizona has no statewide residential electrical code. Each city, town, and county adopts and enforces its own, which is why the same panel swap is a City of Tucson permit inside city limits, a Pima County Development Services permit in the unincorporated county, and an Oro Valley, Marana, or Sahuarita permit inside those towns (PermitMint's Arizona overview).
"Unpermitted" means no application, inspection, and close-out ever happened at the jurisdiction with authority — it does not mean the work is automatically wrong. A fair amount was done competently; it is simply undocumented, a different problem than a bad installation, though a buyer's first reaction to both tends to look the same.
Arizona also lets a homeowner pull a permit and do their own electrical work on a primary residence without a contractor's license — a legitimate path, and also one of the biggest sources of undocumented work, since owner-builders sometimes skip the permit rather than skip the work. Either way the owner stays responsible for code compliance: the rule is about who can do the work, not a lower standard for the result.
The SPDS duty, and what non-disclosure risks
Arizona sellers complete a Seller's Property Disclosure Statement, and it asks directly about known defects and unpermitted work. The obligation is to disclose what you know — not to have already fixed it (Nolo).
Non-disclosure is the real exposure: beyond a renegotiated price if a buyer's inspector catches unpermitted work before closing, a material fact a seller knew about and withheld is a documented basis for a claim after closing (HomeLight). Disclosing and pricing accordingly tends to close cleanly; hoping an inspector misses it bets against fairly good odds of it surfacing anyway (next section), and against a later claim if it is found after the sale instead.
How buyers' inspectors and insurers find it
The panel is the most common flag: an inspector checks make, age, and any permit label against what is on file, and a buyer who pulls the City record and finds no match has the gap on paper before closing.
Scale explains why that gap is common. Tucson has roughly 99,861 parcels built 1950–1989 — the era an unpermitted panel swap matters most — against 1,908 panel and service-upgrade permits the City has issued since 2022: a documented-replacement gap of about 52 to 1. Not a claim that 51 of every 52 such panels are unsafe, just a measure of how little of that housing stock's panel work has a permit trail. Permitted work moved fast, too — a median six days, application to issue, across 1,281 permits.
Panel brand adds a second layer: FPE Stab-Lok and Zinsco/Sylvania panels, installed widely in Tucson homes built 1974–1989, carry a documented failure-to-trip and class-action history; insurers increasingly ask about brand directly, some flagging or declining from photos alone (Dwell Inspect Arizona).
Subpanels, casita circuits, EV chargers, and solar all leave a physical trace — an oversized breaker box, an unexplained 240-volt circuit, roof conduit with no matching permit — that a competent inspector notices without pulling a record. Solar is the clearest case: since 2022, roughly one in five Tucson solar permits (14.8%–23.1% by year) also carried a panel upgrade, so upgraded service plus solar with no matching permit draws a second look. EV-charger permits are still thin citywide — at least one in 2022, at least thirty by 2025, counting only permits with explicit EV-charger language — so an unpermitted charger circuit is closer to typical than unusual today.
A present, finaled permit is strong evidence the work was inspected. An absent one is weaker evidence than it looks — it can mean the work predates reliable digital records, sits with a jurisdiction our tools cannot fully reach, or genuinely never happened. Treat a gap as a reason to look closer, not as a verdict on the house.

Three honest options once you know
Once you know — or suspect — something was never permitted, there are three real paths.
- Permit it after the fact. Most jurisdictions offer an as-built or legalization review: the department inspects the existing installation against current code rather than a pre-construction plan. It can mean exposing covered wiring and making corrections before it closes out — it resolves the record, but takes real time, so start as early as possible.
- Disclose it and price it. State it on the SPDS, let the buyer's inspector and, if they want one, their own contractor evaluate it, and negotiate price or a credit instead of a fix. Most sellers use this option — it protects you precisely because you told the truth.
- Correct it before listing. Have a licensed contractor bring the item to code and, where practical, get it permitted before the house goes on the market, so it is a non-issue at inspection instead of a negotiation point.
How to check your own record before you list
